Conviction Upheld Despite Questions About Evidence of Conspiracy

A conviction for conspiracy to distribute drugs was upheld by the Fourth Circuit on Friday, despite its concerns that the evidence of the conspiracy was weak.

The case highlights the ease with which circuit precedent permits convictions for conduct that overlaps almost entirely with the underlying substantive offense, the opinion by Judge Henry F. Floyd said.
