City of Chicago Avoids Age Discrimination, Harassment Suit

The City of Chicago avoided claims that it violated the Age Discrimination in Employment Act by refusing to promote an engineer within the city’s Department of Water Management when the Seventh Circuit concluded Wednesday that the engineer failed to show that his age, rather than a failing score on a required exam, caused him to miss out on the promotion.

Roman Tyburski sued the city for age discrimination and hostile work environment under ADEA after he was passed over for promotion to Assistant Chief Operating Engineer in 2014.
