Christian Florist’s Discrimination Loss Likely to Stand

Religious businesses that discriminate against same-sex couples are unlikely to fare better at the U.S. Supreme Court than they have in lower courts, scholars told Bloomberg BNA.

A florist’s religious objections were no excuse for refusing to sell flowers for a same-sex couple’s wedding, the Washington Supreme Court held by a 9-0 vote in Washington v. Arlene’s Flowers, Inc., No. 91615-2, 2017 BL 47286 (Wash. Feb. 16, 2017). The florist, Barronelle Stutzman, will ask the high court to review the decision, according to a statement by Alliance Defending Freedom, a conservative organization that represents her.
