Chinese Woman Who Cites Forced Abortion Gets New Asylum Chance

A Chinese woman who says the government forced her to have an abortion deserves another chance at asylum in the U.S. because a judge improperly relied on an asylum officer’s credibility assessment, the Ninth Circuit said.

The immigration judge should have made an independent determination of Lizhi Qiu’s credibility and demeanor, the U.S. Court of Appeals for the Ninth Circuit said Dec. 11.

The judge also erred by relying on omissions in details from Qiu’s asylum statement to find she wasn’t credible, the appeals court said.
