Carnival, Royal Caribbean Beat Appeal Over Property Trafficking

Carnival Corporation and Royal Caribbean Cruises Ltd. have avoided a lawsuit over their alleged “trafficking” of waterfront property in the Port of Santiago de Cuba.

The Eleventh Circuit said the plaintiff, a US National, couldn’t bring his claim under Title III of the Cuban Liberty and Democratic Solidarity Act, also known as the Helms-Burton Act, because he didn’t acquire his interest in the seized property until after the law was passed.

Title III of the Helms-Burton Act was enacted in 1996 to allow US nationals to sue any persons or entities who “traffic” in property confiscated by Fidel Castro’s regime. ...
