California Rep. Speier Faces Appeal in Prerecorded Call Suit

A constituent of Rep. Jackie Speier (D-Calif.) who claimed that she used prerecorded voice messages to call constituents without their consent will appeal a federal judge’s dismissal of the proposed class action to the Ninth Circuit.

Clyde Cheng sued the congresswoman, alleging that she violated the Telephone Consumer Protection Act and the California Unfair Competition Law when she called his cellphone using a prerecorded voice message asking him to participate in town halls. Cheng says he never consented to receive the calls and there were no instructions on how to opt out of them.
