Breyer Says Remote Format May Improve Supreme Court Arguments

Remote Supreme Court oral arguments could have more value if justices focus “on each question and answer,” according to Justice Stephen Breyer.

Time limits imposed after the Covid-19 pandemic prompted the Supreme Court to go remote force the justices “to focus on our questions and to be succinct” and “to listen carefully to what the responses were,” said Breyer, the most senior member of the court’s liberal wing.

Breyer comments appear in a January article in the Journal of Appellate Practice and Process by Margaret D. McGaughey, who interviewed the justice in July 2020. The National Law Journal reported on ...
