Black Juror Illegally Struck Not Entitled to Spot on Final Panel

A black government worker in Kentucky must try again to prove that she faced job retaliation for calling out pay bias, because a juror who was illegally struck and then reseated was wrongly guaranteed a spot among the final deliberating jurors, a state appeals court held Friday.

The decision vacates MarySusan Ward’s $880,031 verdict against the Louisville-Jefferson County Metro Government. Ward sued after her employment ended following a dispute with local Department of Public Health and Wellness assistant director Tammy Anderson, who is white.
