The Federal Circuit didn’t violate the Seventh Amendment by overturning a $1.7 million jury verdict in a patent infringement case, the government said in its recommendation that the US Supreme Court pass on the case.
Patent owner Olaf Sööt Design LLC asked the high court to review the decision, saying the US Court of Appeals for the Federal Circuit based its ruling on its own construction of a patent term and should have allowed the jury time to reconsider infringement given the new definition.
