Amazon Web Users’ Win in Patent Suit Brought Before Justices

The U.S. Supreme Court should rein in the Federal Circuit’s expansion of a patent-specific doctrine barring follow-on lawsuits, a patent owner who was blocked from suing 80 Amazon Web Services Inc. users for infringement said in a petition for review.

The doctrine is an “anachronism” that the Supreme Court hasn’t cited for 70 years, PersonalWeb Technologies LLC argued in its petition.

“In the past seven years, however, the Federal Circuit’s reanimation of the doctrine has spawned a deluge of cases where parties who fail to qualify for claim or issue preclusion try their luck with Kessler instead,” it said....
