The US Court of Appeals for the Fourth Circuit said it lacks jurisdiction to enforce a federal labor board settlement.
The court said in a Friday opinion that it couldn’t enforce a settlement between the United Steelworkers and an aluminum producer in West Virginia because the parties are no longer in conflict. Court enforcement would have “no real consequences for the parties,” Judge Julius Richardson wrote. Therefore, he said, the court doesn’t have the authority to step in.
The settlement sought to resolve complaints that Constellium Rolled Products Ravenswood LLC, withheld information from the union relevant to collective bargaining. ...
