Procter & Gamble Argues for Toothbrush Privacy Suit Transfer (1)

A proposed biometric privacy class action over Procter & Gamble‘s smart toothbrush should be transferred to Ohio federal court because of language in the accompanying smartphone app’s terms of use, the company is arguing in Illinois federal court.

Those terms, which plaintiff Jan Gamboa agreed to when he used the app, require the case to be litigated in the Southern District of Ohio, attorneys representing Procter & Gamble argued in a motion to transfer venue filed Wednesday in the U.S. District Court for the Northern District of Illinois.
