Manhattan Auto Dealer Spam Text Case Certified as Class Action

A lawsuit alleging Manhattan Luxury Automobiles sent unsolicited text messages in violation of the Telephone Consumer Protection Act can proceed as a class action, a federal court ruled.

The lawsuit arose after MLA sent text messages offering maintenance and inspection services to customers of a sister dealership that had gone out of businesses.

Judge Lorna G. Schofield of the US District Court for the Southern District of New York approved two classes for the suit, one composed of customers of the former dealership who received texts using the Zipwhip messaging platform, and the second composed of members of the first ...
