Locast Loses Copyright Fight with Broadcasters Over Streaming

A nonprofit streaming service isn’t exempt under the Copyright Act from paying to transmit over-the-air broadcast signals, a New York federal court ruled in a win for CBS Studios Inc., NBC Universal Media LLC, and other major broadcast networks.

The payments that the service, Locast, calls donations aren’t equivalent to donations made to charities, wrote Judge Louis L. Stanton for the U.S. District for the Southern District of New York. Locast was not the type of nonprofit that Congress thought would benefit from a provision that allows nonprofits to freely stream broadcast signals, Stanton said.
