European Commission Eyes New Framework for Essential Patents

The European Commission is preparing a regulation with a new licensing framework for patents that are essential to technological standards, including critical telecommunications.

The commission, Europe’s administrative arm, previously signaled its interest in creating a clearer licensing framework. It said in a new published initiative that the system for licensing standard-essential patents isn’t “transparent, predictable and efficient.”

“This initiative will create a fair and balanced licensing framework and may combine legislative and non-legislative action,” the commission said.

It is expected to begin seeking public feedback this year, and have a proposal by the end of 2022.
