Airbnb User Loses Initial Challenge to Chicago Home-Sharing Law

A Chicago ordinance regulating short-term “home sharing” rentals, like those facilitated by Airbnb Inc., tentatively survived a wide-ranging constitutional challenge Tuesday, when a federal judge threw out claims that the law violates the First, Fifth, and Eighth amendments.

Judge Sara L. Ellis dismissed the case from the U.S. District Court for the Northern District of Illinois, saying the condo owner leading the lawsuit had “pleaded himself out of court” by asserting several fatally flawed legal theories, others that require more detail, and a few that aren’t ripe for decision.
