NYC EMS Officers, Union Denied Class Status in Job Bias Lawsuit

New York City, its fire department, and related parties defeated a motion by emergency medical services officers and their union for class certification in a race, sex, disability, and leave discrimination lawsuit.

The 2018 lawsuit filed by Luis Rodriguez, Renae Mascol, and Local 3621, EMS Officers Union, DC-37, AFSCME, and AFL-CIO claims disparate treatment and disparate impact bias infects promotions to leadership positions. The plaintiffs sought certification of three classes consisting of thousands of officers allegedly denied elevation to the supervisory emergency medical specialist level between 1996 and the present.
