Immigrant Reentry Law With Racist Beginnings Is Constitutional

A claim that the US’s illegal reentry statute violates the equal protection clause because of its allegedly racist history was rejected by the Fifth Circuit Friday.

The law makes it a crime for any immigrant who was previously excluded, deported, or removed from the US to reenter the country without appropriate authorization.

Yobani Barcenas-Rumualdo, who was convicted for violating the law, claimed that it violated the Fifth Amendment because it was originally the 1929 Undesirable Aliens Act, which was tainted with animus toward Mexican and Latino immigrants.
