FOIA Suit Over Transgender Asylum-Seeker’s Death Reinstated

The Transgender Law Center won reinstatement of its FOIA suit seeking information about the in-custody death of a transgender immigrant, as the Ninth Circuit said Thursday that the government fell short of its obligation to search for documents and didn’t properly account for withholding records.

Roxsana Hernandez, 33, entered the US seeking asylum on May 9, 2018. She was fleeing her home country of Honduras after experiencing persecution because of her identity as a transgender woman. She was detained by US Customs & Border Patrol.
