EPA Avoids Utah Ranch Developer’s Superfund Liability Lawsuit

The EPA can avoid a lawsuit by a Park City, Utah, resort group that says it can’t develop part of its property due to possible contamination, as a federal court in the state said an ongoing investigation at the property blocks the suit.

Courts can’t consider Superfund citizen suits until after a removal action is complete, according to the U.S. District Court for the District of Utah.
