Army Corps of Engineers Must Defend Port Redevelopment Plan

The U.S. Army Corps of Engineers must face an Administrative Procedure Act claim brought by a Black Texas homeowner who alleges that racial bias is behind a plan to improve access to a local harbor, the Fifth Circuit ruled Thursday.

Manning Rollerson owns property in Freeport, Texas, in a neighborhood established in the 1930s as the only area of the city where Black people could buy homes at the time, the court said. Rollerson alleged that the port plan violated his civil rights when property owners were threatened with condemnation and takings by eminent domain.
