SEC Internal Memo Access Irrelevant to SCOTUS Case, Agency Says

A database mixup that allowed some staff in the SEC’s Enforcement Division access to in-house adjudicatory memos is “not relevant” to the jurisdictional question at the center of a U.S. Supreme Court petition, the government told the court.

There’s “no evidence” staff tasked with investigating and prosecuting allegations against Michelle Cochran, a CPA, before the Securities and Exchange Commission’s administrative law judges accessed or used memos intended only for the eyes of the agency’s adjudicatory team, the U.S. Solicitor General Elizabeth B. Prelogar, representing the agency, said in a letter to the high court.
