Bayer Should Get High Court Review on Roundup, Groups Say

The U.S. Supreme Court should grant review to Bayer AG in a $25 million Roundup case because standards for expert evidence are too lax in the Ninth Circuit, two groups told the justices in friend of the court briefs.

The “Ninth Circuit has truly gone rogue” in interpreting the evidence rule for allowing expert testimony, the Product Liability Advisory Council said in a brief Oct. 1.

And that circuit, “ignoring” the requirement that expert evidence be reliably applied to a case, is in conflict with at least six other federal appeals courts, the Washington Legal Foundation said Monday.
