Alphabet Loses Bid to Revisit Investor Suit Over Google+ Flaw

Alphabet Inc. must face allegations that the company misled investors about security problems with its Google+ platform after the Ninth Circuit declined to review a June decision allowing the case to proceed.

A three-judge panel of the U.S. Court of Appeals for the Ninth Circuit on Friday denied Alphabet’s petition for a rehearing or a rehearing en banc.

Chief Judge Sidney Thomas and Judges Jacqueline Nguyen and Sandra Ikuta voted unanimously not to revisit the ruling and found no interest for an en-banc review after circulating Alphabet’s petition among the Ninth Circuit’s other judges, the order said.
