Review Panel Bucks E-Filing Policy in Remanding OSHA Fine Appeal

A Missouri construction company was given a second chance to appeal $21,844 worth of alleged OSHA violations when a review panel overturned an administrative law judge’s decision, suggesting there should be some leeway in an e-filing policy.

The Occupational Safety and Health Review Commission, in a remand order released Thursday, said the judge was “too harsh” in dismissing the employer’s appeal because it had failed to use the commission’s electronic filing system and meet court deadlines.
