Judge Overturns OSHA Citation for Construction Worker Deaths

A federal safety violation stemming from the deaths of two Texas utility construction workers has been vacated by an appellate review panel.

OSHA failed to prove that contractor Maslonka Power Line Services of Spokane, Wash., allowed a front loader fitted with lifting prongs to be operated outside of the vehicle’s design limits, according to a final order released Thursday by the Occupational Safety and Health Review Commission. The OSHRC decision also vacated the proposed $13,260 fine for the single alleged serious violation.
