A construction company’s history of enforcing its fall protection policies helped convince an administrative law judge to vacate an OSHA citation alleging the firm failed to safeguard a worker from a fatal fall.
The company, Miller Insulation Co. Inc. of Bismarck, N.D., showed it had issued its workers 23 disciplinary notices for fall protection problems in the year before the April 19, 2019, accident, ALJ Christopher Helms said in his order released Thursday vacating the citation.
