ACLU’s Meatpacking Plant Safety Suit Rejected by Nebraska Judge

A Nebraska federal court dismissed an ACLU lawsuit seeking an injunction it said was needed to stop a meatpacking firm from exposing its workers to the coronavirus.

Rejecting the suit, Chief U.S. District Judge John M. Gerrard said the individuals represented by the American Civil Liberties Union were former, not current, employees of the defendant Noah’s Ark Processors LLC, and therefore lacked standing to sue.

“It would be different were the plaintiffs, say, current employees of Noah’s Ark. Then, their risk of COVID-19 might be fairly traceable to their workplace, and injunctive relief in their favor might mediate that risk,”...
