USPLabs Supplement Criminal Case Stays on Track

Criminal charges against USPLabs LLC, its officers, and other alleged co-conspirators stemming from the manufacture of tainted dietary supplements will all be tried together before a single jury, a federal court in Texas ruled.

USPLabs and SK Laboratories Inc., the supplier of its imported stimulants, and six other individual defendants raised concerns that prejudicial evidence against one of them could unfairly “spillover” and affect them all.

But that concern can be cured by proper jury instructions, the U.S. District Court for the Northern District of Texas said Nov. 7.
