Travelers Sued Over Coverage for Hep A-Tainted Strawberries

Travelers Insurance Co. of Canada breached its contract to provide a produce distributor with up to $10 million in coverage for a Hepatitis A outbreak linked to imported strawberries, according to a recent complaint (Patagonia Foods, LLC v. Travelers Ins. Co. of Canada, E.D. Va., No. 17-cv-01059, filed 9/20/17).

The action is the latest wave of litigation that began with personal injury and class action suits by customers of Tropical Smoothie Cafe stores, as well as suits against its distributors and importers, over virus-laced strawberries from Egypt that sickened 149 people in nine states last year.
