Tesla Buyers Must Arbitrate Most Pre-Owned Car Battery Claims

Tesla Inc. can compel several used-car buyers to individually arbitrate most claims in a suit alleging it overstates the battery life of some pre-owned electric vehicles, the Central District of California said.

But Hugh Nguyen may proceed in court on his claims seeking public injunctive relief under California’s consumer protection laws because he can’t be forced to arbitrate those claims, the U.S. District Court for the Central District of California said.

The plaintiffs raised warranty claims, and alleged Tesla violated California’s False Advertising Law, Consumers Legal Remedies Act, and Unfair Competition Law. Tesla argued their claims all must be individually ...
