Tank Maker Faces Trial Over Fertility Patients’ Destroyed Eggs

Manufacturer Chart Industries Inc. may have to face a trial on fertility patients’ product liability and failure-to-recall claims stemming from a cryopreservation tank failure that resulted in the destruction of hundreds of human eggs and embryos, a California federal court said.

The five plaintiffs, whose eggs and embryos were among those affected, presented evidence that the tank used at the Pacific Fertility Center didn’t function as an ordinary user would expect. That proof is sufficient to allow a jury to hear their strict liability claims, the U.S. District Court for the Northern District of California said Monday.
