Race Car Driver Loses Bid to Keep Fiery Crash Suit in Nebraska

A Canadian injured in a race car fire can’t sue a Georgia part maker in Nebraska, where the race took place, the U.S. District Court for the District of Nebraska ruled.

The court doesn’t have jurisdiction over Roswell-based Postell Associates Inc., Magistrate Judge Cheryl R. Zwart said June 5.

Postell allegedly made a seat belt assembly that kept driver Brett Derkach, of Saskatoon, Saskatchewan, from escaping the fire. The G-Force Racing Gear Pro Series camlock harness didn’t operate properly, Derkach alleges. He sustained severe burns and smoke inhalation, he says.
