R.J. Reynolds Strikes at Minnesota City’s Flavored Tobacco Ban

Federal law preempts an Edina, Minn., ordinance banning sales of flavored tobacco products, including menthol cigarettes, because Congress gave the U.S. Food and Drug Administration that authority, R.J. Reynolds Tobacco Co. and other members of the industry told the Eighth Circuit on Thursday.

The ordinance must be struck down, they argue in their appeal of a lower-court loss. Tobacco product regulations belong in the FDA’s hands, they say.
