The widow of a Navy machinist who died from mesothelioma will have another opportunity to pursue asbestos exposure claims after Maryland’s highest court ruled that pump manufacturers may face liability for asbestos parts manufactured by third parties (May v. Air & Liquid Sys. Corp., 2015 BL 416603, Md., 5, 12/18/15).
There was sufficient evidence that the asbestos-containing parts were required for the pumps to function properly, the Maryland Court of Appeals said.
As a result, the court said, the case falls within an exception to the “bare metal defense” articulated by courts in New York and Illinois....
