Ocean Spray, Consumers Near Settlement in Juice Labeling Suit

Ocean Spray Cranberries Inc. has reached a settlement in principle in a proposed nationwide class suit alleging it deceptively marketed numerous drinks, according to a new filing in the District of Massachusetts.

Michael Froio and Mikhail Surman sued Ocean Spray in the Massachusetts federal court, alleging “no artificial flavors” label statements on some of its products are false and misleading because they actually contain artificial malic and fumaric acids as flavoring agents.

Crystal Hilsley filed a similar suit in the Southern District of California, which certified a California class last year. Last month, the court refused to decertify the class,...
