Commercial general liability insurance policies issued to home builders do not cover damage allegedly caused by emissions from Chinese drywall, a federal district court held March 24 (General Fidelity Insurance Co. v. Foster). Applying Florida law, the U.S. District Court for the Southern District of Florida said sulfide gases released by the drywall qualify as “pollutants” under the policies’ pollution exclusion clause.
