Nestlé Says Alleged Non-Disclosure of Child Labor Not Deceptive

Nestlé USA Inc. told the First Circuit its alleged failure to disclose on product labels the use of child labor in its cocoa supply chain was neither “deceptive” nor “unfair” under the Massachusetts consumer protection law.

Danell Tomasella’s proposed class suit was properly dismissed, Nestle told the U.S. Court of Appeals for the First Circuit in an Oct. 1 brief.

Tomasella acknowledged that Nestlé created no misleading impression and that its website disclosed the risk of forced child labor in its West Africa supply chain, the brief said.
