Hill’s, Mars Petcare Face ‘Prescription’ Pet Food Fraud Claims

Mars Petcare US Inc. and Hill’s Pet Nutrition Inc. must face would-be class claims alleging they deceived pet owners into thinking “prescription” pet food was subject to government oversight and had medicinal value that conventional products didn’t have, a majority of the Ninth Circuit said Tuesday.

Tamara Moore and other California residents raised viable claims under California’s False Advertising Law, Unfair Competition Law, and Consumers Legal Remedies Act because they showed that a reasonable consumer could be misled, the the U.S. Court of Appeals for the Ninth Circuit majority said.
