Gunmaker Blamed for Exploding Rifle Faces Trial on Design Defect

Thompson/Center Arms Inc. must proceed toward trial on an injured man’s claims that a design defect in a muzzleloading rifle caused it to explode, but punitive damages are off the table, a federal court in Utah ruled.

The gunmaker also faces claims that it breached a warranty it allegedly offered for the “lifetime of the original consumer purchaser,” even though the injured user wasn’t the original purchaser, Judge David Nuffer said Monday for the U.S. District Court for the District of Utah.
