Costco Defeats Brain Injury Suit Tied to Exploding Bottle

Costco Wholesale Corp. won’t face an Arizona man’s brain injury claims stemming from a sparkling wine bottle that exploded when it fell from a cashier’s conveyor belt, a federal court in Arizona ruled.

The everyday activity of checking out at a warehouse or grocery store isn’t an inherently dangerous activity, the U.S. District Court for the District of Arizona said.

Robert Johnson also failed to show Costco breached any duty of care in the operation of the conveyor system at its store in Gilbert, Ariz.
