College Sheds Suit Over Student Sexual Assault Inquiry

A male student’s claims that the University of St. Thomas was negligent in its investigation of sexual assault allegations against him can’t proceed, a federal court in Minnesota ruled.

The investigation by the St. Paul, Minn.-based private college was flawed, but the student didn’t establish the school breached its duty to fairly investigate the claims, the U.S. District Court for the District of Minnesota said Feb. 21.

Communications between a university factfinder and its appeal officer about the merits of the disciplinary findings were improper but harmless, the court said.
