Chinese Drywall Class Won’t Exclude Former Home Owners

Chinese drywall manufacturers failed to trim a class action stemming from allegedly shoddy drywall installed in the wake of Hurricanes Rita and Katrina.

Taishan Gypsum Co., its subsidiary Taian Taishan Plasterboard Co., and other Chinese-based defendants lost a bid to exclude plaintiffs who sold or lost their home through foreclosure or bankruptcy from the class.

The plain language of the class definition includes those claimants, the court said.

Taishan had an opportunity to shape the class definition in 2014, but declined to do so, the court said.
