Chart Industries Defeats Class Status Bid Over Destroyed Embryos

Cryopreservation tank maker Chart Industries Inc. won’t face a class claim over whether alleged defects in a tank at the Pacific Fertility Center in San Francisco caused the destruction of over 600 human eggs and embryos, after a federal court said certification on causation only would be inefficient.

Certifying a class for purposes of determining if the tank was defectively designed and manufactured, if the defect was capable of causing the destruction, and if Chart knew about the defect and didn’t correct it, wouldn’t serve judicial economy and efficiency, the U.S. District Court for the Northern District of California said ...
