Champion Petfoods Denied Early Exit from Dog Food Label Suit

Champion Petfoods USA Inc. says it will fight a proposed class suit challenging the marketing of two premium dog food products, following a recent ruling that denied the company an early exit.

Jennifer Reitman alleged Champion touts its Acana and Orijen foods as premium and “biologically appropriate,” even though they contain undisclosed residues of lead, arsenic, cadmium, and mercury.

Champion argued the failure to allege a harmful level for any of the heavy metals dooms the complaint, because none of the statements is deceptive without such an allegation.
