BMW of North America Not Liable as Manufacturer in Car Fire Suit

BMW of North America LLC won’t face claims brought by a woman injured when her car caught fire, after the Western District of Tennessee found the company isn’t a “manufacturer” under Tennessee law.

The Tennessee Products Liability Act bars defective product claims against any seller other than the manufacturer.

Brenda Woods’s claims against BMW of North America fail because it only imported and sold her car, the U.S. District Court for the Western District of Tennessee said Nov. 8.

Bayerische Motoren Werke Aktiengesellschaft designed and manufactured the 2010 BMW 528i in Germany.
