Bausch & Lomb Cataract Lens Suit Barred by Federal Device Law

Bausch & Lomb Inc. won dismissal of a woman’s suit alleging artificial lenses caused vision problems, as a federal court in Connecticut said federal medical device law preempts the claims.

Marjorie Glover alleged Trulign Toric lenses impanted in her eyes to replace her natural lenses after cataract surgery caused “Z-Syndrome,” a complication she blamed for vision loss, dizziness, and other problems. She alleged Bausch & Lomb didn’t warn her doctors about Z-Syndrome and failed to meet regulatory requirements for reporting adverse events to the Food and Drug Administration.
