Apple iPhone Battery Class Claims Proceed

Worldwide class claims alleging Apple Inc. fraudulently throttled battery performance of older iPhones with software updates will proceed, a federal court in California ruled.

But the Northern District of California trimmed some claims Oct. 1 asserted by phone owners who live outside the U.S. The court also dismissed some claims filed under the federal Computer Fraud and Abuse Act and California tort laws.

Both the claims on behalf of the non-U.S. plaintiffs, and the federal and California claims, can be amended and refiled, however.
