Amazon Defeats Appeal in Caffeine Powder Death Suit

Amazon.com Inc. fended off an appeal over the death of a teen who suffered caffeine toxicity allegedly linked to caffeine powder sold by a third party on the retailer’s site.

A trial court properly found Amazon provided only a platform for the transaction and wasn’t a “supplier” subject to liability under Ohio product liability law, an Ohio appeals court said.

Cases from other jurisdictions show a disinclination to hold Amazon liable as a seller, distributor, or supplier of products offered for sale on its site by third parties, the Ohio Court of Appeals said Feb. 19.
