3M Loses Bid to Get Noise Data From Military in Earplug Suits

The U.S. Department of Defense isn’t dragging its feet in response to a series of document requests by 3M Co. in litigation over allegedly defective earplugs and shouldn’t be forced to generate the information, a federal magistrate judge said.

The department reasonably explained that some of the data doesn’t exist or isn’t readily available, Magistrate Judge Gary R. Jones said Monday in a report to the U.S. District Court for the Northern District of Florida.
